How this is reached

  • Getting up and preparing for trial, at least one third of the instruction fee Schedule 6, paragraph 2 KES 25,000
  • The taxing officer may increase or reduce the instruction fee, taking into account the nature and importance of the matter, the amount involved, the interest of the parties and the conduct of the proceedings.
  • A suit for possession of premises or for specific performance of a lease is valued by a rule of its own, not by the price of the land. Switch the nature of the suit above if that is this matter.
  • This is a minimum, not a quotation. Advocates Act (Cap 16) section 36 makes it an offence to charge or accept less than the prescribed remuneration otherwise than in part payment, and section 46(d) makes any agreement to accept less void.
  • Value added tax and disbursements are charged on top of the figure above.

What this does not know

This computes the scale fee from the value you type. It does not know what the value of the subject matter is in your matter, and that is usually the argument. Paragraph 1 of Schedule 6 lets the taxing officer increase or reduce the fee for the nature and importance of the cause, the interest of the parties and the conduct of the proceedings. Suits for possession of premises and specific performance of leases are valued by a separate rule. Attendance, perusal, drawing and service items are charged on top and are not computed here. Treat the result as the floor to argue up from, not as a taxed bill.

What the scales pay, side by side

Ordinary defended suit, no certificate. The two court columns are advocate and client minimums, which is what you bill; what the losing side pays is two thirds of it. The conveyancing column is the fee on a sale or purchase of the same value, payable to each side's advocate.
