In plain terms
Works out the minimum an advocate is allowed to charge for a case or a property transaction, which is set by law rather than by the advocate.
What to know first
It computes the scale from the value you give it. It cannot know what the value of the subject matter is in your matter, and that is usually the argument. The taxing officer may increase or reduce the fee. Attendance, perusal and drawing items are charged separately and are not computed here.
How to use it
- 1 Pick the matter: High Court suit, subordinate court suit, sale or purchase, or security.
- 2 Enter the value of the subject matter or the consideration.
- 3 For a suit, say whether it is an ordinary claim or one for possession of premises. A possession suit is valued by a rule of its own, not by the price of the land.
- 4 Say how it was disposed of and whether a defence was filed.
- 5 Read both figures: what you may bill your client, and what is recoverable from the other side.
- 6 Tick a senior counsel or two-advocate certificate where the judge gave one.
- 7 Read the working under the figure. That is what a taxing officer will want to see.
